MAX MANUFACTURING - 50 YEAR LIMITED WARRANTY

LENGTH OF WARRANTY. This warranty from Max Manufacturing LLC becomes effective when Max Manufacturing LLC is paid in full and remains in effect for a period of fifty (50) years from the date of original purchase.

PERSONS PROTECTED. This warranty will be enforceable during the warranty period by the original owner and any subsequent owners of the building on which the Max Slate Product is originally installed. This warranty is given exclusively by the Manufacturer, and not by the dealer or contractor from whom you purchased the tile. To obtain warranty service, contact Max Manufacturing LLC.

WHAT IS COVERED. Except as otherwise specified, this warranty covers any tile that is defective or damaged sufficiently to cause leakage resulting from: 1) defects in material or workmanship; 2) wind (up to 110 mph); 3) ice; 4) frost; 5) rain; 6) hail (up to one (1) inch in diameter); 7) sleet; 8) snow; 9) cracking, warping or splitting as a result of temperature change or weathering; or 10) rotting due to aging or weathering.

WHAT IS NOT COVERED. The following are not covered: damaged tile resulting from: 1) improper installation (Installation and Specification Manual available to installers upon request); 2) lightening, fire; 3) falling, thrown or blown objects; 4) vandalism; 5) malicious actions; 6) acts of war, riot or insurrection; 7) inferior building practices (does not meet standard minimum national building code common to the local area, i.e. ICBO, BOCA, SSBC, FHA, UBC, etc.); 8) glacier type snow and ice slides or snow and ice falling from upper roof areas which can be prevented by proper ventilation, gutters, heat tapes, and snow guards; 9) lack of normal building maintenance; 10) failure or deterioration of building components other than Max Products; 11) Improper use or spillage of materials, liquids or chemicals not compatible with Max Products; 12) normal wear and tear including the natural effects of progressive aging on the color and surface of the tile.

HOW TO OBTAIN WARRANTY PERFORMANCE. Notice of any damaged tile must be given to the company, in writing, within thirty (30) days of the time the damage becomes apparent. The notice should be sent to Max Manufacturing LLC 1101 Industrial Drive, Albion, Michigan, 49224. Proof of Purchase, photos and samples showing the extent of the damage or problem must be included with this notice, by the owner, and at owner¹s expense. If, after review of information and damaged Product, (including a visit to the site at manufactures discretion), the investigation proves manufacturing defects or damage covered by this Warranty, Max Manufacturing will replace Product in accordance with this Warranty.

WHAT WE WILL PROVIDE. We will provide replacement tile, for covered damaged tile, at no cost, F.O.B. our factory in Albion, Michigan, but owner must pay any labor costs for installation of replacement tile. After the first 5 years, this Warranty will be prorated. That is, Max Manufacturing will pay a percentage of the balance at a depreciating value per month, In Product or credit which can be calculated by dividing the number of months remaining in the Warranty period by the number of months in the original Warranty period.

LIMITATION OF IMPLIED WARRANTIES. ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY AND FITNESS FOR PARTICULAR PURPOSE, ARE LIMITED IN DURATION TO THE LENGTH OF THIS WARRANTY.

EXCLUSION OF CERTAIN DAMAGES. MAX MANUFACTURING LLC LIABILITY IS LIMITED TO PROVIDING REPLACEMENT TILE AS SET FORTH ABOVE AND SHALL, IN NO EVENT, INCLUDE INCIDENTAL OR CONSEQUENTIAL COMMERCIAL DAMAGES OF ANY KIND.

SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS AND/OR DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS AND EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
